LayoverLink is a social networking service that is designed primarily for airport travelers to locate other airport travelers. The LayoverLink sites and integrated services (collectively, "website" or "site") are owned and operated by LayoverLink, LLC ("LayoverLink," "us," "our" or "we"). By accessing our site, you become a "user" of our site and are subject to these Terms of Use ("terms"), regardless of whether you have registered with us. Any use of this site outside of its primary function may be deemed to be in violation of the terms of use. If you do not agree to or follow these terms, do not access or use the site.

Eligibility
The LayoverLink website is solely intended for users who are 18 years of age or older. Any use of or access to this site by anyone under the age of 18 is unauthorized and in violation of the Terms of Use. Use of the LayoverLink website, including account registration and posting of messages or photos, is void where prohibited.

Account information
By signing up for an account with us, you agree to provide and maintain accurate and up-to-date information within your account profile, including during the registration process. You are also fully responsible for the use of and activities that occur through the use of your account.

Restrictions on use
You are expected to use your account in an honorable and tasteful manner, consistent with the rules outlined below.

User accounts
By signing up for an account, you agree that you are the person whose name appears as the registered user on the account. We do not allow accounts to be created for fictitious beings, businesses, animals, inanimate objects, or similar things. When you create your account, you are responsible for all of the information posted to your account, including but not limited to your personal information, password, travel itineraries, profile information, blogs, photos, forum posts, and other information maintained by you. We do not authorize any account sharing between users. You are solely responsible for protecting your account password. If you suspect that someone else is using your account or has gained unauthorized access to your account, please inform us of such actions.

User content
You declare that you own any content that you load onto LayoverLink, and that loading the content does not violate any copyrights, trademarks, patents, or the privacy of any other person or entity. You retain any ownership rights that you may have for any content you load onto LayoverLink.

LayoverLink prohibits the loading or posting of content that is deemed harassing, violent, contains nudity or is otherwise sexually exploitive, promotes illegal activity, threatens the security of any person or entity, solicits personal information from anyone under the age of 18, solicits passwords or personal information from other users, involves unauthorized commercial activities or corrupt endeavors, or in any other way violates the rights of another person or entity. LayoverLink reserves the right to take appropriate actions, including but not limited to removing the content, against users loading any content that meets any of this stated criteria, and any other content it deems to be offensive or otherwise harmful to LayoverLink or its users.

You agree to pay any fees or other similar expenses or obligations to any person, business, or other entity resulting from the violation of one's rights in association with the posting of content on LayoverLink.

Advertising
The LayoverLink site is available for your personal, non-commercial use only. Using your account for any commercial reason or promotion is strictly prohibited and may result in the termination of your account.

If you are aware of any violation of these terms by any user, please contact us using the contact form or by sending an email to abuse@layoverlink.com.

Disclaimer
The information contained on this website is provided "as is" without warranty of any kind. The entire risk as to the results and the performance of the information is assumed by the user, and in no event shall LayoverLink, LLC be liable for any consequential, incidental or direct damages suffered in the course of using the information found on this website. Use of the information contained on this website is governed by the respective license agreements and may contain restrictions on use.

Third party content
There is content ("third party content") provided on our website, posted by both us and our advertisers, that may originate from other websites ("third party sites"), including text, images, audio and video content, and links. It is against the Terms of Use for our users to post links to, or display unauthorized or illegal content from third party websites. Third party content is not monitored for accuracy or appropriateness, and we are not responsible for the material contained on third party sites or the policies and practices of such sites. Limitation of liability
In no event shall LayoverLink be liable to you or any third party for any damages arising out of the use of this site or any of its services. Notwithstanding anything to the contrary contained herein, our liability to you for any cause, regardless of the form of action, will at all times be limited to the amount paid by you to us for our service during your membership. If you have not paid any fees to us, you acknowledge that you will be limited to injunctive relief only, unless otherwise permitted by law, and you shall not be entitled to damages of any kind from us.

Indemnity
You agree to indemnify and hold LayoverLink and its affiliates, along with their respective agents, officers, partners, contractors and employees harmless from any loss, liability, demand, or other claim, arising out of the misuse of this website, including areas of user-managed and posted content, or violation of any law or other users' or third parties' rights.

Termination
LayoverLink reserves the right to terminate a user's account at any time for any reason (or no reason), including, but not limited to being under the age of 18, posting false information within your profile or elsewhere on the site, promoting illegal activities, or otherwise violating these Terms of Use. Following the termination of an account, we may retain all data maintained within that terminated account, including profile data and information posted under the account. This agreement will remain in effect after any account termination.

Disputes
Our users are responsible for the resolution of disputes between each other, even if they arise from the use of this website. In order to avoid disputes with other users of this site, we suggest that our users be respectful when using our site.

Trademarks and copyright infringement
LayoverLink and all other product or service names or slogans presented on Layoverink.com and LayoverLink.mobi are registered and/or common law trademarks of LayoverLink, LLC, and may not be used, in whole or in part, without the prior written permission of LayoverLink. Also, page headers, logos, designs, custom graphics, button icons and scripts, are trademarks of LayoverLink, and may not be used, in whole or in part, without the prior written permission of LayoverLink. All other trademarks, registered trademarks, product names and company names or logos that appear on LayoverLink are the property of their respective owners, and your use of these entities is governed by the respective owners' terms of use agreements.

Other
This agreement is immediately accepted by you upon your use of the LayoverLink website and is further affirmed by your account registration with LayoverLink. This agreement constitutes the entire agreement between you and us, and the choice by us not to act upon or enforce any violation of this policy does not imply a waiver of any such rights or provision. This agreement operates to the fullest extent of the law, and if any parts of this agreement are unlawful, void, or unenforceable, those portions shall be considered severed from this agreement, with the remaining parts staying active, intact, and enforceable.

Changes to the terms of use
We reserve the right to modify these terms at any time without any further notice, and should modifications take place, the updated terms will be posted on this website, with the date of the last revision indicated at the top of the page. It is the responsibility of our users to review any changes to these terms by checking regularly on the site. All prior versions of these terms will be archived and available to you upon request.
